UNANIMOUSLY RESOLVED that:
a. The application for Consolidation of Erf 103504 and 103505 Cape Town at Rylands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law 2015.
b. The application for Rezoning of the consolidated property comprising Erf 103504 and 103505 Cape Town at Rylands, from Single Residential 1 and General Business 1 respectively to General Residential 4 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law 2015, subject to the conditions contained in Annexure A, attached hereto
c. The application for Consent to permit retail use on the ground level of the consolidated property comprising Erf 103504 and 103505 Cape Town at Rylands BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law 2015 subject to the conditions contained in Annexure A, attached hereto.
d. The application for Regulation Departures relating to building lines, floor factor, coverage and parking on Erf 103504 and 103505 Cape Town at Rylands, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law 2015.
REASONS FOR DECISION
The MPT APPROVED the application for consolidation, rezoning and consent,
for the reasons set out in the Planner’s Report
The MPT REFUSED the application for regulation departures, for the reasons set out in the planner’s Report.
Amend condition 2.1.2 in Annexure A:
‘A detailed Site Development Plan (SDP) … Particular attention must be paid to the interface between the property, the surrounding residential erven and the two adjoining roads…’
