RESOLVED UNANIMOUSLY that:
An administrative penalty in the amount of R1000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 30332 Cape Town, with regard to the unauthorised 3600m2 parking area for the place of instruction (University of Cape Town).
REASONS FOR DECISION:
The MPT APPROVED the application for the reason as set out in the Planner’s report except reason 6.6 which is amended and an additional reason that reads as follows:
6.6 The conduct in this particular case is not regarded as willful.
6.8 no evidence regarding willfulness.
