RESOLVED UNANIMOUSLY
a. That the application for consent use to operate a guest house from erf 7773, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions attached as annexure A.
b. That the application for permanent departure in respect of erf 7773, Milnerton, in order to relax the 4,5m common boundary building line (applicable to guest houses) to 2,0m from the south-western boundary, 3,0m from the north-western boundary and 2,0m from the north-eastern boundary, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, only in so far as to allow the proposed additions, as indicated on the Site Layout Plan, No. 020-2016 M001 rev 6, dated 22/03/2018, drawn by “Arkey”.
c. That the application for permanent departure in respect of erf 7773, Milnerton, in order to relax the 5,0m street boundary building line (applicable to garages and carports) to 0,0m, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, in accordance with the Site Layout Plan, No. 020-2016 M001 rev 6, dated 22/03/2018, drawn by “Arkey”.
d. That the application for permanent departure in respect of erf 7773, Milnerton, in order to relax the on-site parking requirement for the 5-bedroom guest house from 7 bays to 5 bays (excluding existing double garage), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, in accordance with the Site Layout Plan, No. 020-2016 M001 rev 6, dated 22/03/2018, drawn by “Arkey”.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report.
Amend Annexure A:
2.3 In light of the MPT concerns regarding access and egress, the site layout plan to be revised to address these concerns to the satisfaction of the authorized official.
