RESOLVED UNANIMOUSLY:

An administrative penalty in the amount R1500.00 BE DETERMINED for the unauthorized land use and an administrative penalty of R3500.00 be determined for the unauthorized building work in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015, in respect of Erf 4725, Grassy Park, as shown on the plan with drawing no. P-406, drawn by Garin Browers and dated 16 Dec 2022.
REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report, except reason 6.5 which is amended at follows:

6.5. The owner continued to operate the house shop even after becoming aware that building plan and land use approval was required. This conduct cannot be condoned.
