UNANIMOUSLY RESOLVED that:
The application for the amendment of a title deed condition in Deed of Transfer T57840/2018, pertaining to Erf 1094 Pinelands, as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2019.
Recommendation 9.2 and 9.3 (correct numbering should be 8.2 and 8.3) is deleted and will be addressed by delegated authority
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following changes:
Amend reason 7.1 as follows:
7.1 The proposal complies with Section 99(1) of the Municipal Planning By-Law.
Amend reason 7.8 as follows:
7.8 The amendment of the title deed and land use conditions does not adversely impact on the area as the MPBL will be the control to guide any future development of the site.
Add reason 7.10 as follows:
7.10 In the assessment of the application, regard was given to Section 39(5) of LUPA and Section 47 of SPLUMA
Amend Annexure A:
Amend heading of paragraph 1.2 as follows:
1.2 In terms of Section 42(j): Amendment of previous conditions of approval
