a. An administrative penalty of R 2 000.00 BE DETERMINED for the unauthorised land use in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 6312, Mitchells Plain

b. An administrative penalty of R 1 000.00 BE DETERMINED for the unauthorised building work in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 6312, Mitchells Plain

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reasons6.4 as follows:

6.4 The applicant’s conduct is willful, as the land use contravention notice served, has not been complied with. Furthermore, the house shop has continued to operate even with the court proceedings taking place – for this reasonsthe MPT panel increased the penalty amount
