UNANIMOUSLY RESOLVED that:
An administrative penalty of R 4 000.00 BE DETERMINED for the unauthorised building work in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 1076, Eerste River

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reasons6.3 as follows:

6.3 The gravity is serious, as people are being accommodated in habitable structures without building plans being approved, thereby potentially putting the safety of occupiers at risk. There is also a potential threat to the safety of abutting neighbours – this warrants an increase in the penalty amount
