RESOLVED UNANIMOUSLY:
8.1 The application for consent use in order to permit the sale of alcoholic beverages (small scale Liqour store) and to permit a take away restaurant on Remainder Erf 4825, Parow, BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-law, 2015, subject to the conditions in Annexure A.
8.2 That the application in respect of Remainder Erf 4825, Parow for permanent departures from the City of Cape Town Development Management Scheme to permit the following:
a. Relaxation of the Street (5th Avenue) building line from 5.0m to 2.72m to permit new service station canopies.
b. Relaxation of the Splay (cnr 5th Avenue and Ryan Street) building line from 5.0m to 0m to permit the erection of new service station canopies.
c. To permit a deviation from item 57 [b] [i] and [iii] and 140 of the DMS relating to the width of the carriageway crossings on 5th Avenue and the number of carriageway crossings per site for service stations.
BE APPROVED in terms of 98(b) of the Municipal Planning Bylaw in accordance with the Site Development Plans No 2021-07-005, Rev No. JJ dated 14.11.2022 attached as Annexure C.
APPLICATION GRANTED 1.2 is amended as follows:
1.2. Permanent departure in terms of Section 42(b) of the Cape Town Municipal Planning By-law, 2015 to permit the following:
a. Relaxation of the Street (5th Avenue) building line from 5.0m to 2.72m to permit new service station canopies.
b. Relaxation of the Splay (cnr 5th Avenue and Ryan Street) building line from 5.0m to 0m to permit the erection of new service station canopies.
c. A deviation from item 57 [b] [i] and [iii] and 140 of the DMS relating to the width of the carriageway crossings on 5th Avenue and the number of carriageway crossings per site for service stations as depicted on the SDP attached as Annexure C.
d. Relaxation of the Splay (cnr 5th Avenue and Ryan Street) building line from 5.0m to 0m and from 5m to 3,5m to permit the erection of new service station canopies and truck filling pump island.
Additional Condition
- That the liquor sold will not be for onsite consumption.
