RESOLVED UNANIMOUSLY that:
a. The application for the deletion and amendment of restrictive title deed conditions, as set out in Annexure A, for Erf 50356 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The application for deletion and amendment of conditions of an existing approval, as set out in Annexure A, for Erf 50356 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for rezoning of Erf 50356 Cape Town at Newlands from Single Residential Zone 1 to General Residential Subzone GR2, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
d. The application for consent for a hospital in terms of Item 40(b) of the Development Management Scheme, for Erf 50356 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to conditions as set out in Annexure A.
e. The application for departures, as set out in Annexure A, for Erf 50356 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
Condition 3.5.1 is as follows:
3.5.1 The owner/developer shall pay a development charge (DC) in accordance with the approved Development Charges Policy for Engineering Services for the City of Cape Town. The total amount payable for the proposed land use right in accordance with the attached DC calculation is R99 038.83. It must be noted that this amount is valid until 30/06/2020 and that the amount due will be escalated annually with the Construction Price Adjustment Formula (CPAF) using the industry indices of StatsSA. DC’s will be payable prior to the approval of building plans or within 30 days of the approval of this application, whichever comes first.
Note: Failure to pay this fee will be construed as non-compliance the conditions of approval.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report.
