RESOLVED UNANIMOUSLY

a. That the application for deletion of restrictive title deed conditions, as set out in Annexure A, for Erf 114510 Cape Town at Rondebosch, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. That the application for the subdivision of Erf 114510 Cape Town at Rondebosch, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/00/114510, subject to the conditions contained in Annexure A

c. That the application for Council’s approval in terms of Item 162(1) of the Development Management Scheme, as set out in Annexure A, for Erf 114510 Cape Town at Rondebosch, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

The MPTSW Panel approved the reasons in the planner’s report except reason 7.1.8 which is amended as follows:

7.1.8 The deletion of title deed conditions has been assessed in terms of factors as set out in the Municipal Planning Bylaw 2015, Land Use Planning Act, 2014 and the reasoning is set out in the report. It has been determined that the deletion of the conditions will not impinge on people’s property rights as contemplated in Spatial Planning and Land Use Management Act, 2013.
