RESOLVED UNANIMOUSLY

That an administrative penalty in the amount of R409 be imposed in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 1259, Mamre, in respect of the early childhood development centre, and such penalty BE APPROVED in terms of Section 98(b) of the said By-Law.

REASONS FOR DECISION:

1. The applicant has not previously contravened the By-Law.
2. The applicant has taken the necessary steps to regularize the unauthorized activity.
3. The activity is a much needed facility and caters to the needs of the surrounding community.
4. That there is a concern about the safety of the children and therefore it is imperative that permission should be obtained beforehand.
