RESOLVED UNANIMOUSLY that:
a. The application for Subdivision of Remainder Erf 1, Burgundy, into five Agricultural Zoned (AG) portions, plus the creation of a 5m wide ‘temporary right of way’ servitude, BE APPROVED, in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with Subdivision Plan No SP-00-001, Revision D, dated 12 August 2022 (see Annexure C), subject to the conditions contained in Annexure A.
b. The application for Permanent departure to permit 5 newly created Agricultural Zoned (AG) portions that ranges between 2.1ha, 1.51ha, 2.89ha, 15.54ha and 1.02 ha respectively in lieu of 20ha each, in respect of subdivided portions of Remainder Erf 1, Burgundy, BE APPROVED, in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with Subdivision Plan No SP-00-001, Revision D, dated 12 August 2022 (see Annexure C), subject to the conditions contained in Annexure A.
Additional Condition
That portion 1 be consolidated with the future Phase B of De Aanzicht to the north
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the planner’s report, except reason 7,1,1, 7.1.2 and 7.1.3 which are deleted
