UNANIMOUSLY RESOLVED that:
a. The rezoning of erf 105333, Cape Town, from Single Residential Zoning 1: Conventional Housing (SR1) to General Business Subzoning 1 (GB1) BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
b. The regulation departure from item 140(2)(a) of the Development Management Scheme to allow for more than one (1) vehicle carriageway crossing per public street on erf 105333, Cape Town, BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
c. The regulation departure from item 141(1)(b) of the Development Management Scheme to allow vehicles to reverse onto the sidewalk on erf 105333, Cape Town, BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
d. The regulation departure from item 141(1)(b) to allow nine (9) parking bays in lieu of 11 parking bays on erf 105333, Cape Town, BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add a reason as follows:
7.1.6 The parking departure is considered to be minor in relation to the context and location of the property, there is public parking provision opposite the road and the departure is considered minor and is supported
