UNANIMOUSLY RESOLVED that:
a. The application for rezoning of the property from Mixed Use Sub-zone 2 to Mixed Use Sub-zone 3 for Erf 11091 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
b. The application for Permanent departures in terms of Item 64 (c)(i) to permit a portion of the proposed building 25 m above the base level to be located at 0.0 m and 0.83m in lieu of the permitted 2.915 m from the south eastern common boundary, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A in accordance with the plans attached as Annexure G.
c. The application for City’s approval in terms of Item 162 of the Development Management Scheme, to permit building work within a Heritage Protection Overlay Zone (HPO/2/7), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A in accordance with the plans attached as Annexure G.
d. The application for City’s approval in terms of Item 121(2) of the Development Management Scheme to permit portion of the proposed building to be located closer than 5.0 m from Albert Road designated metropolitan road boundary building line, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A in accordance with the plans attached as Annexure G.
e. That the application for Subdivision to permit the servitude rights of ways of 3 servitudes for vehicles and pedestrians over Erf 11092 in favour of Erf 11091, Woodstock, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A, in accordance with the Servitude Plan in Annexure H.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reasons as follows:
xi The proposal will not adversely affect the significance of a heritage place or heritage area.
xiv That an appropriate mix of unit sizes be incorporated in the proposal
Note: The Tribunal noted that there are numerous public sector social housing initiatives being undertaken in the Woodstock-Salt River area
Amend Annexure A:
2.3 The maximum development envelope and mix of unit sizes, vehicular access, parking layout and the treatment of the street level interface, shall be generally as shown on the Site Development Plan attached as Annexure G
3.1 Correct the DC amount to be R 582 809.23
