RESOLVED UNANIMOUSLY:

That an administrative penalty in the amount of R6 900 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 800 Kraaifontein in accordance with the plan herby attached as Annexure B.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the planner’s report except the reason related to gravity which is amended as follows:

1. The Gravity is very serious because most of the property is used for the ECD, as well as the adjacent Council owned property. Due to the ECD operating from the existing dwelling, building line encroachment is deemed a technical departure. No additional buildings were constructed to accommodate the ECD. Because the activity is unauthorized no comment has been received as yet from internal departments to determine the impact of the ECD. The health and safety of 52 children could therefore be compromised.
