RESOLVED UNANIMOUSLY that:

a. The application for the Rezoning of Erf 3871, Durbanville in terms of Section 42(a) of the Municipal Planning By-Law, 2015 from Single Residential 1 (SR1) to Subdivisional Area Overlay Zoning to permit General Residential Zone 2 and Open Space 3 (Private Road), BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015 subject to the conditions contained in Annexure A.

b. The application for the Subdivision of subdivision of Erf 3871, Durbanville in terms of Section 42(d) of the Municipal Planning By-Law, 2015, into 7 portions, to create:

- 6 erven Group Housing Units
- 1 Erf for private Road purposes

BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015 as per subdivision plan number Erf3871_Sbu1 dated 27 August 2019 attached as Annexure C, subject to the conditions contained in Annexure A.

c. The application for Regulation Departure in terms of section 42(b) of the Municipal Planning By-Law, 2015, from item 35(b) of the Development Management Scheme to permit maximum gross density on the group housing site to be 42 units per hectare in lieu of 35 units per hectare BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the plan attached as Annexure D.

d. The application Regulation Departure in terms of section 42(b) of the Municipal Planning By-Law, 2015, from item 35(f) of the Development Management Scheme to permit the garage door facing onto the road to be setback 0.0m in lieu of 5.0m BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the plan attached as Annexure D.
