RESOLVED UNANIMOUSLY that:
a. The application for the subdivision in respect of Erf 135315, Cape Town into 2 portions (Portion 1 and Remainder), BE APPROVED in terms of section 98(b) of the City of Cape Town Municipal Planning By-law, 2015 in accordance with the plan of subdivision plan no. 5.005_2_02_02, dated 15/10/2019 included with Annexure C, subject to the conditions contained in Annexure A.
b. The application for the rezoning in respect of the subdivided Portion 1 referred to in 8.1 above, from General Business (GR1) to Subdivisional Area BE APPROVED in terms of section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, in accordance with land uses indicated in the subdivision plan no. 5.005_2_02_02, dated 5/11/2019 included with Annexure C subject to the conditions contained in Annexure A.
c. The application for the subdivision in respect of the portion of Erf 135315, Cape Town rezoned to Subdivisional Area, into into 30 portions, BE APPROVED in terms of section 98(b) of the City of Cape Town Municipal Planning By-law, 2015 in accordance with the plan of subdivision plan no. 5.005_2_03_02, dated 5/11/2019 included with Annexure C, subject to the conditions contained in Annexure A.
Condition 2.4 and 2.18 are amended as follows:
2.4. That the City’s general requirements pertaining to subdivisions shall be applicable and that no Section 137 Clearance Certificates shall be issued prior to instalment of all services referred to in 2.3 above.
WATER AND SANITATION (CATCHMENT PLANNING)
2.18. That a Stormwater Management Plan (SWMP), must be submitted which depicts the entire stormwater management strategy for erf 135315-RE, Cape Town (0.339 ha). The SWMP must indicate e.g. underground internal stormwater reticulation system, attenuation and treatment facilities, potential trap low areas, connector services and overland escape routes. Such SWMP to be submitted prior to or together with submission of engineering drawings, to include a viable Landscaping Plan.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report, except reason 7.1.3 which is deleted.
