RESOLVED UNANIMOUSLY that:
a. The application for permanent departure to permit a common boundary building line of 0m in lieu of 3m for a carport on Erf 35483, Bellville BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015 in accordance with plan no Z35483(1 of 1).
b. The application for temporary departure to permit the operation of a liquor shop on Erf 35483, Bellville BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015 in accordance with plan no Z35483(1 of 1).
REASONS FOR DECISION:
The MPT partially APPROVED and partially REFUSED the application for the reasons in the Planner’s report except reason 7.2.1 and 7.2.3 which are amended as follows:
Reasons for the recommended decision for refusal relating to the application for the temporary departure may be summarized as follows:
7.2.1 The proposed liquor shop is viewed to be out of character with the surrounding predominantly single residential area: the property is embedded in a crescent.
7.2.3 The proposal is not compliant with all the desirability criteria in terms of Section 99 of the Municipal Planning By-Law, 2015: specifically, compatibility, socio economics and impact on the wellbeing of the surrounding community.
