RESOLVED UNANIMOUSLY that:

a. The application for the amendment of condition 2.1.5 of approval in respect of Erf 6232, Matroosfontein that prohibits the sale of alcohol from the existing house shop BE REFUSED in terms of Section 98 (c) of the Municipal Planning By-law, 2015.

b. The application for temporary land use departure in respect of Erf 6232, Matroosfontein to allow for the sale of alcohol from a portion of the subject property, BE REFUSED in terms of Section 98 (c) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

The MPT REFUSED the application for the reasons in the Planner’s report, except reasons 7.1.2 which is amended and added two additional reasons, 7.1.3 and 7.1.4 that read as follows:

7.1.2The proposed use is also considered to have an adverse impact on the wellbeing on the surrounding community.
7.1.3 The locational context of the property is considered to be inappropriate for the conducting of the use which could negatively impact the socio-economic wellbeing of the surrounding community
7.1.4 The liquor store component does not satisfy the desirability criteria containing in Section 99(3) of the Municipal Planning By-law
