UNANIMOUSLY RESOLVED that:
a. The application for regulation departure from the DMS for Erf 5946, Somerset West, to permit the relaxation of the 6m common building line (adjoining Erf 5945) to 1,63m to regularise the existing retaining wall and pergola, as reflected on plans no 1823/SDP01 – 1823/SDP04, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. The application for regulation departure from the DMS for Erf 5946, Somerset West, to permit the relaxation of the 6m common building line (adjoining Erf 5941) to 4,76m to allow for the conversion of the existing outbuilding (entertainment lapa) to a second dwelling, as reflected on plans no 1823/SDP01 – 1823/SDP04, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.



c. The application for Regulation departure from the DMS for Erf 5946, Somerset West, to permit the relaxation of the 6m street building line to 4,77m for proposed additions to the main dwelling, as reflected on plans no 1823/SDP01 – 1823/SDP04, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

d. The application for Regulation departure from the DMS for Erf 5946, Somerset West, to permit the relaxation of the 11m height restriction to 12,9m for proposed additions to the main dwelling, as reflected on plans no 1823/SDP01 – 1823/SDP04, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

e. The application for Regulation departure from the DMS for Erf 5946, Somerset West, to permit the relaxation of the 9m wallplate height to 12,45m and 10,25m for proposed additions to the main dwelling, as reflected on plans no 1823/SDP01 – 1823/SDP04, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

f. The application for Regulation departure from the DMS for Erf 5946, Somerset West, to regularise an existing retaining wall of 4,6m in height in lieu of the specified maximum of 2m, as reflected on plans no 1823/SDP01 – 1823/SDP04 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

g. The application for Regulation departure from the DMS for Erf 5946, to allow the two carriageway crossings to be located within 12m of each other, as reflected on plans no 1823/SDP01 – 1823/SDP04, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
