Resolution details

a. Consent to regularize the use of the existing building on Erf 910, 95 Fagan Street, Strand, for the purposes of an institution (a home for the care of a maximum of 22 Alzheimer patients), be approved in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. FP/0219/940, dated March 2019, subject to the conditions contained in Annexure A hereto;

b. A permanent departure for the relaxation of the 5 m common boundary building lines, along the lateral boundaries on Erf 910, 95 Fagan Street, Strand, to approximately 1,3 (Western) and 1,99m (Eastern), respectively, be approved in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. FP/0219/940, dated March 2019, subject to the conditions contained in Annexure A hereto;

c. A permanent departure for the under-provision of on-site parking (3 bays, in lieu of the required 4 bays, on Erf 910, 95 Fagan Street, Strand, be approved in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no. FP/0219/940, dated March 2019, subject to the conditions contained in Annexure A hereto.

REASONS FOR DECISION
The MPT APPROVED the application for the reason set out in the Planner’s Report and agreed to add:

7.8 Concerns expressed by the objectors have been adequately addressed

Amend Annexure A:
2.1.4 That patients displaying noisy / disruptive behaviour be confined to portions of the building where their actions will have the least impact on neighbouring property owners

2.1.5 That the operator shall implement a noise management plan and sound absorption interventions within the building, i.e. curtains, ceiling insulation, double glazing etc., so as to lessen the impact of possible audio-disturbances on surrounding property owners, and that noise nuisance shall be kept within acceptable noise level decibels for residential areas
