UNANIMOUSLY RESOLVED that:
a. The application for relaxation of a restrictive title deed condition, as set out in Annexure A, in respect of erf 1476, Camps Bay, BE APPROVED in terms of section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.
b. The application for permanent departures as set out in Annexure A, in respect of erf 1676, Camps Bay, in accordance with Annexure C, BE APPROVED in terms of section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend Annexure A:
1. APPLICATIONS GRANTED IN TERMS OF SECTION 98 (b) OF THE BY-LAW
1.1. Relaxation of a restrictive condition [conditions E.5.(b) and E.5.(d)] in title deed T67542/2011 as follows:
- Condition E5 (d): To permit the proposed garage extension to be 1.5m in lieu of 7.87m from the street boundary.
- Condition E5 (d): To permit the proposed garage extension to be 1.941m in lieu of 3.15m from the south eastern common boundary.
- Condition E5 (d): To permit the proposed additions (studio staircase) to be located at 6.87m in lieu of 7.87m from the street boundary
1.2. Permanent departures:
- Item 22(d): To permit the proposed garage extension to be setback 1.941m and 2.024, in lieu of 3m from the south eastern common boundary.
- Item 22(d): To permit the proposed garage extension (support pillar) to be setback 2.024, in lieu of 3m from the south eastern common boundary.
- Item 22(d): To permit the proposed garage extension to be setback 1.5m in lieu of 5m from the street boundary.
The north sign to be correctly shown on all the relevant plans attached to the case. (Annexure C1 and C2)
