UNANIMOUSLY RESOLVED that:
a. The removal of the restrictive title deed conditions B.1.(b), B.1.(c), B.1.(d) and C. j. as set out in title deed T88084/1996 in respect of Erf 5407, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The amendment of the original town establishment condition as set out in Annexure A in respect of Erf 5407, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. The removal of the restrictive title deed condition B.1.(a) as set out in Annexure A in respect of Erf 5407, Milnerton BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

d. The amendment of the original town establishment condition in respect of limiting the use of the property to residential use as set out in Annexure A in respect of Erf 5407, Milnerton, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.


e. The rezoning of Erf 5407, Milnerton, from Single Residential Zoning 1: Conventional Housing (SR1) to General Residential Zoning 1: Group Housing (GR1) BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

f. The regulation departure to allow for 3 units to be erected at 3,9m in lieu of the 5m external street building line (Jamieson Street) on erf 5407, Milnerton, BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

g. Regulation departure to allow for 2 units and a garage to be erected at 0m and 1,6m in lieu of the 3m external common building line on Erf 5407, Milnerton, BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report and agreed to amend the following:

Paragraph heading 7.1 to be amended as follows:
Reasons for the removal of the restrictive title conditions B.1.b. to B.1.d. and C.J may be summarized as follows:

Delete paragraph 7.3
