UNANIMOUSLY RESOLVED that:
a. The regulation departure to permit the encroachment of the 3m western common building line to 0.23m in respect of erf 11040, Table View, as per Annexure C, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A;

b. The regulation departure to permit the encroachment of the 3m southern common building line to 1.85m in respect of erf 11040, Table View, as per Annexure C, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A;

c. The regulation departure to permit the encroachment of the 3m eastern common building line to 0.9m in respect of erf 11040, Table View, as per Annexure C, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A;

d. The regulation departure to permit the encroachment of the 1.5m window setback in respect of erf 11040, Table View on the eastern common boundary to 0.9m, as per Annexure C, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

REASONS FOR DECISION
The MPT APPROVED recommendations 8.2, 8.3 and 8.4 for the reasons set out in the Planner’s Report.

The MPT REFUSED recommendation 8.1 for the following reasons:

The proposed departure to 0.23m for both ground and first floors on the western common boundary is unacceptable from a privacy and visual impact on the only immediate adjoining residential property

Amend Annexure A:
2.1 Building plans to be submitted in accordance with the approval granted, except for the encroachment on the western boundary, to the satisfaction of the Director: Development Management

Delete 2.2
