RESOLVED TO RECOMMEND
 
Subcouncil 20 supports the lease of a portion of unregistered state land vesting in the City of Cape Town as a Public Street, being portion of 74013 Cape Town situated at the Corner of Gabriel and Constantia road, shown hatched and lettered ABC on the attached plan LT 1622v1 marked annexure A, in extent approximately 318m², to Shell Downstream South Africa (Pty) Ltd, owner of Erf 74013 Cape Town or its successor in title be approved subject, to inter alia the following conditions, that:
 
  1. A market rental of R8 800 per month inclusive of rates and excluding VAT calculated at the rate applicable at the time of transaction be payable;
  2. The monthly rental escalates 6% per annum commencing 2 months from date of valuation. Accordingly, the above recommended rental is effective and payable from 2020-05-01;
  3. The rental will escalate at 6% per annum
  4. The lease will endure for a period of 10 years, the rental to be reviewed after 5 years;
  5. Beneficial occupation of R8 800 per month, escalating at 6% per annum be charged as from 1/05/2020 until such time as the lease agreement signed;
  6. The property be used for parking and commercial purposes, gardening, access and egress purposes and for no other reason whatsoever;
  7. Subject to such further conditions imposed by the Director; Property Management in terms of her delegated authority;
  8. Subject to compliance with any other statutory requirements;
  9. No compensation will be payable for any improvement made to the property.   .
