RESOLVED
Subcouncil 6 noted and recommended to the Director: Property Management the following:
That the lease of a portion of Erf 26949, Bellville, situated at Mimosa Crescent, Belhar, Bellville shown by the figure lettered ABCD on the Plan No TA 952v1 marked as Annexure A attached to the report, in extent 125m² , to Daniel Paulse and Jeanetta Lorraine Paulse or their successors in title, be approved subject to inter alia the following conditions, that:
a) A tariff of R835,65 per annum exclusive of VAT be payable. Rates not applicable;
b) The lease will endure for a period of ten years;
c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
d) The property be used for gardening and security purposes only;
e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
f) Subject to compliance with any other statutory requirements;
g) No compensation will be payable for improvement made to the property;
h) No buildings or structures of any kind may be erected on the property;
i) A way leave must be obtained from the City’s Water and Sanitation Department for any work on the property within 3m from any municipal services on the land;
j) Any alteration to electricity services necessary as a consequence of the proposal or requested by the applicant will be carried out at the cost of the applicant;
k) Unrestricted 24 hour vehicular and personnel access must be maintained for the purpose of accessing and maintaining municipal services;
l) The applicant may not remove any boundary or fence common to the leased area;
m) No excavation may take place on the property without the permission of a way leave and work permit;
n) The City of Cape Town has the right to construct and/or erect and lay such poles, stays, cables, wires or appurtenances as may be necessary, together with the right to use, inspect, maintain, repair, alter, relay and/or remove all such poles, stays, cables, wires and appurtenances. This includes the right to bring machinery onto the property and to carry out excavations;
o) No building containers or structure may be erected within 3m of the electricity services.
