RESOLVED TO RECOMMEND
Not Delegated: Final decision Council and noting by Subcouncil 7
a) In terms of Sections 14(2)(a) and (b) of the Local Government: Municipal Finance Management Act 56 of 2003:
i) Council decide and resolve that Erven 397, 398 & 399, Durbanville at Bergsicht & Tristan Streets, measuring approximately 3099.83m², 2453.75 m² and 792.77 m² respectively (Annexure A for the Transfer Plan), is not needed to the provide the minimum level of basic municipal services; and
ii) Council confirm that the fair market value of the capital asset and the economic and community value to be received in exchange for the capital asset described in (a)(i) have been considered;
b) In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R. 878 promulgated on 22 August 2008, Council approve in principle that Erven 397, 398 & 399, Durbanville as described in (a)(i) above may be transferred; and
c) Erven 397, 398 & 399, Durbanville may be transferred by a competitive process, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority.
