UNANIMOUSLY RESOLVED
That it BE NOTED that the following application for a new liquor licenses was considered in terms of subdelegated authority and that the following recommendation was forwarded to the Liquor Authority in terms of the Western Cape Liquor Act 2008, as amended, during the period June and July 2018:
1. LLA1805028 - Shoprite Liquorshop Durbanville

We note the concerns from the Durbanville Community Police Forum who supports the application with conditions.
1. Should trading with foodstuffs take place on the premises, the applicant must apply for a Certificate of Acceptability in terms of the Regulations governing General Hygiene for Food Premises and the Transport of Food R962 dated 23 November 2012 as promulgated under the Health Act 1977 (Act 63 of 1977) – Application forms available from Ms D Williams at 021 444 6738.
2. The premises must comply with the Tobacco Products Control Amendment Act No. 12 of 1999.
3. The premises must comply with the Western Cape Noise Control Regulations, R200 of 20 June 2013. Should complaints regarding noise emanating from the premises be received, Council reserves t4. All refuse must be stored in such a manner as not to create a health nuisance pending removal.
5. The premises must be rodent proof in terms of the Prevention of Rodent Infestation, Regulation No 1411 of 1966.
6. All employees must have access to sanitary facilities.
7. The premises must comply with the City of Cape Town: Control of Undertakings that sell liquor to the public By-Law, 2013.
8. The Director: City Health reserves the right to call for any additional requirements should it be deemed necessary.
And further subject to security patrol on site during business hours he right to withdraw any approval granted.
2. LLA1806001 - Fives Sports Bar
Not supported
Against the background of the facility being established to promote five a side soccer for local school children the need for the selling and serving of liquor cannot be supported. Although the zoning of the said premises allows for such business. Furthermore the facility as developed is adjacent to a registered retirement facility.
3. LLA1806006 - Col’Cacchio Pizzeria, Durbanville

Subject to the applicant meeting with the comments received from the Health Department which reads as follows:
This department cannot support the approval of an on-consumption liquor licence as the premises does not have the necessary ablution facilities for on-consumption (food or liquor) as required by the Regulations Governing General Hygiene Requirements for Food Premises and the Transport of Food No. R. 962 of 23 November 2012. This premises has a business licence and certificate of acceptability for take-away only.
