RESOLVED TO RECOMMEND Subcouncil 20 supports the recommendation that the lease of portion of public street being a portion of Erven 3405 and 12389 Constantia situated at Lismore Avenue, Tokai, shown hatched and lettered ABCDEFGHJ on the attached plan LT 332v3 marked Annexure A, in extent approximately 120m², to David Howard Charles Waters and Siyolisile Waters, owners of Erf 3421 or their successors in title, be approved subject to inter alia the following Conditions, that: a) A tariff rental of R835.65 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable; b) The lease will endure for a period of ten years; c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council; d) The property be used for gardening purposes only and no fencing other than the existing will be permitted within the lease perimeter; e) Subject to such further Conditions to be imposed by the Director: Property Management in terms of her delegated authority; f) Subject to compliance with any other statutory requirements; g) No compensation will be payable for any improvement made to the property with or without the consent of the Council, should the lease be terminated for any reason whatsoever. h) Electricity services exists within the vicinity of the lease area and any alterations with deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicant’s cost. i) No Telkom services are known to exist within the vicinity of the lease area but it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan; j) It must be known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times. k) Where a water meter exists it should be accessible for water meter reading and maintenance purpose by City of Cape Town staff.
