UNANIMOUSLY RESOLVED that: 1.The application received from Orasec (PTY) Ltd t/a Club for a business licence for health and entertainment: Nightclub or Discotheque on erf 4065, 4 Buiten Street, Cape Town, BE GRANTED subject to the following standard endorsements for this category of licence: a)This business licence must be displayed prominently in a conspicuous place in or on the premises to be visible to patrons, the public and Council officials at all times. b)This business licence is not transferable from person to person or from business to business. c)The premises must comply with the requirements of the Tobacco Products Control Act, Act 83 of 1993, at all times. d)The Director: City Health reserves the right to call for any other requirements that may be deemed necessary. e)The approval of this licence does not exempt the holder compliance with any other licences, conditions or statutory requirements. f)The premises must comply with the requirements of the Western Cape Noise Control Regulations, P.N. 200 of 2013, at all times. g)The premises must comply with the fire requirements at all times. h)The main entrance door for Club 40/40 must be kept closed when the venue is operating and should be monitored by a dedicated staff member. i)The premises must comply with the requirements of the Western Cape Noise Control Regulations, P.N. 200 of 2013, at all times. j)The premises must comply with the fire requirements at all times. k)The main entrance door for Club 40/40 must be kept closed when the venue is operating and should be monitored by a dedicated staff member. l)The courtyard exit for Club 40/40 must be kept closed when the venue is operating and should be monitored by a dedicated staff member. m)The sound system installed in the venue is a fixed system and does not go beyond the sound pressure level measured in the Acoustic Engineer’s report, which is 93.0dBA. n)The in-house sound system is fitted with audio equipment. This audio equipment is to be set to control the maximum level of music to 93.0 dBA inside the establishment. This must be demonstrated to the City of Cape Town’s investigating officer on request at any given time. o)It is compulsory that only the in-house sound system is to be utilized by the owner, or all visiting entertainers. p)No other audio equipment is to be utilized at all. 2. Authority be granted to the Head: Environmental Health to sign and issue the necessary licence in (1) above.
