Meeting date: 15/10/2018
Subsequent to the September Subcouncil meeting, a meeting including Cllrs Kempthorne, Bryant & the SC manager was held with Transport department and Law Enforcement. The meeting was informed of the continuous enforcement of the cycle lanes with regard to illegal parking. It was agreed that no changes to By-Laws were required. This matter can therefore be removed from the MRA.
Email from Shaun Glass d/d 22/08/18 - I met with Deputy Traffic Chief Andre Nel on Monday on this issue. He confirms that there are no amendments required to either By-law to effectively enforce against obstruction of cycle lanes. It is a matter of resources. He, in fact, regularly calls his officers to come out when he sees people parked on the lanes in Bree Street. He also informed me that Traffic Services wishes to purchase about 8 removal vehicles that will be deployed to remove illegally parked vehicles across the city. Funds are apparently available in the current financial year and the tender for the vehicles has been issued or has already closed (not sure which). I think that it will be better for Traffic Services to present to the SC on this matter as I suspect that there will be follow-up questions in the meeting around resourcing and frequency and the new removal vehicles. Cllr Bryant requested that a presentation regarding the cycle lanes be presented at the next meeting. Cllr Golding would like Adderley and Bree Streets cycle lanes to be included.
14/08/18: Cllr Bryant stated that he raised the issue with the Traffic Chief. Had a site inspection with Deon Manuel two weeks ago. Deon will take up augmentation of parking bays. Email from Sean Glass d/d 8/8/18: I don’t believe that a meaningful report on the amendment of By-laws is possible before the SC meeting. It seems that no action has been taken to amend either By-Law. I cannot say with certainty whether there is a need to amend the By-laws. Teuns Kok is looking for some old correspondence from Traffic Services that might indicate whether they think the By-Laws require amendment to enable them to keep cycle lanes clear. He is looking for that today. If it indicates that a change is required then it is my view that the change should be to the Traffic By-Law and not the Parking By-Law (I won’t go into my reasons here but will wait for the information from Teuns). If we agree with S&S that the Traffic By-Law should be amended then they should lead that process.
18/06/18: Email from Ms Nehna Singh d/d 18 June 18 - While the notes listed are acknowledged, it should be emphasised that where cycle lanes are added without the necessary enforcement team included, it is impractical to be managed. In response to point 2.1 the matter has been reported to the Safety and Social Services Portfolio Committee Chairperson, Councillor Mzwakhe Nqavashe and the amendment to the traffic by-law will be presented to caucus. The Parking bylaw and other matters raised are for the attention of TDA

The Subcouncil manager advised that a meeting comprising Cllrs Kempthorne, Bryant, himself and representatives of the Transport and Law Enforcement departments was held to address this matter. It was agreed the cycle lanes would be continuously monitored to ensure adequate enforcement in cases where vehicles caused obstructions.
Cllr Dave Bryant stated that the obstruction of cycle lanes is an ongoing problem and should be addressed by the Transport Department. In the meantime, this matter may be removed from the MRA schedule.
