UNANIMOUSLY RESOLVED that the following comments BE NOTED: That an application for a liquor licence received from LA FAMILIA RESTAURANT was considered in terms of sub-delegated authority and that the following recommendation was forwarded to the Liquor Authority in terms of the Western Cape Liquor Act, 2008, as amended: Subcouncil 16 recommends that the application for a Consumption ON Premises Liquor Licence, reference no. LLA1803024, for the business LA FAMILIA RESTAURANT NOT BE SUPPORTED, The Subcouncil objects strongly to this application for the following reasons: 1. The premises is situated within a residential area and as indicated by a number of objectors, a licensed premises in this area will impact very negatively on the community. 2. In particular, an operating license until 2 am will unreasonably disturb through music, night noises and bottles in refuse lane, the residents who share the service lane ( buttresses and shared with 7 residential cottages), and many of which house small babies, children and families. The applicants of the license have cleared thoroughfare and changed the locks on the gates to the servitude. Their intention is clearly to use the servitude for deliveries and refuse. This will make life for the abutting neighbours exceedingly unpleasant, particularly if drinking continues on the premises until 2 am. 3. In view of the above, it is evident that granting this application is undesirable due to the negative impact it will have on the community and should therefore not be granted.
