RESOLVED TO RECOMMEND Subcouncil 20 supports the recommendation to lease portions of City land, being portions of Erven 79488, 114066 and 114067 Cape Town, situated at Toulon Road, Diep River, shown hatched and lettered ABCDE on attached Plan LT 1450v0 and marked annexure A, in extent approximately 587 m², to A J Pienaar and J I Fabing, owners of Erf 126030, Cape Town or their successors in title be approved, subject to inter alia the following conditions, that: a) The lease will endure for a period of ten years with an option to renew for a further ten years; b) A tariff rental of R2372,68 per annum excluding VAT of 14% where applicable, being R332,32 (in total – R 2706) be payable; c) Payment of annual rates will apply, if applicable; d) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council; e) The land will be used for gardening purposes only; f) If applicable, the submission and approval of any necessary building plans in terms of the National Building Regulations should be submitted to the Planning Department. g) Any boundary fence is to be of a non-permanent type. h) Any fence that does not require the submission of plans in terms of the National Building Regulations will still require the approval of the Director: Property Management. i) Subject to such further conditions be imposed by the Director: Property Management in terms of her delegated authority j) Subject to compliance with any statutory requirements; k) Any alterations or deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicants cost. l) Where a water meter exists, it should be accessible for water meter reading and maintenance purposes by City of Cape Town. m) It is the responsibility of the applicant to notify Telkom immediately should the applicant locate Telkom plant which might not be indicated on the plan; n) It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times; o) Unrestricted access to the proposed lease is to be provided. p) No compensation will be payable for any improvement made to the property. q) All outstanding accounts with the City of Cape Town must be settled.
