RESOLVED ON 19 FEBRUARY 2018 Ms Jansen informed the subcouncil that the meeting have been arranged for 20 February 2018. RESOLVED That the item be closed and removed from the matters receiving attention. FOR INFORMATION: ALL RESOLVED ON 22 JANUARY 2018 Mr Pieter Strumpher spoke to the matter and informed the meeting that the lease section confirmed that the public participation was concluded in December 2017, and that a report will soon be provided to Subcouncil 6. The chairperson read the response received from Mr W van Gass regarding the query whether Ward Allocations could be utilised to pay for the application fees to lease council properties, and stated that Council money cannot be used to pay for Council tariffs Cllr B van der Merwe requested that a meeting be arranged with Mr P Strumpher, G van Wyk and D Willenberg on viable and non –viable land. RESOLVED a) That the item remain on the matters receiving attention until the outstanding items have been actioned. b) That a meeting be arranged with Cllr B van der Merwe, Mr P Strumpher, G van Wyk and D Willenberg regarding viable and non –viable land. FOR ACTION: PAT JANSEN RESOLVED ON 20 NOVEMBER 2017 Ms Pat Jansen requested Mr P Strumpher to explain the process to follow with regards to leases for gardening purposes. Mr P Strumpher explained that leases for gardening purposes are not advertised but there is an application fee that the applicant must pay when applying for the lease. If the property in question has one erf number the applicants can split the fee amongst them and do one application. Cllr B van der Merwe enquired whether the application fee can be paid from Ward Allocation funding. Ms Pat Jansen requested Mr W van Gass to investigate whether this request is in line with the Municipal Finance Management Act (MFMA). She also requested that Mr P Strumpher submit a progress report to the January 2018 meeting with regards to the process for the leases. Cllr B van der Merwe requested that the Subcouncil Manager arranges a meeting between himself Mr P Strumpher, Gerna Du Plessis (Head of Leasing) and the Subcouncil Chairperson to discuss the matter. Cllr van der Walt requested to be invited to this meeting. RESOLVED a)That the item remains on the matters receiving attention. b)That Mr P Strumpher submits a progress report at the January 2018 meeting with regards to the process of leases. c)That the Subcouncil Manager arranges a meeting between Mr P Strumpher, Cllr B van der Merwe, Cllr L van der Walt, Gerna Du Plessis (Head of Leases) and the Subcouncil Chairperson to discuss the matter. FOR ACTION: PIETER STRUMPHER PAT JANSEN RESOLVED ON 16 OCTOBER 2017 That the Subcouncil Manager arranges a meeting with Legal Services and Property Management to explain the purpose of advertising the leasing of the Groenvallei properties simultaneously. Subcouncil 6 considered the report and supports the following recommendation to the Executive Director: Assets and Facilities Management: That the lease of a Portion of Erf 15657, Public Street, Brandvlei Street, Groenvallei, Bellville, shown hatched and lettered ABCD on the plan TA 372v0, marked as Annexure A to the report, in extent approximately 75m², to Mrs Elizabeth Magdalena Ellis the owner of Erf 19035 or her successors in title be approved subject inter alia to the following conditions that: a) A tariff rental of R371.93 per annum exclusive of VAT; b) The lease will endure for a period of ten years; c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council; d) The property be used for security purposes only; e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority; f) No building structures will be permissible on the leased property; g) The owner needs to submit an application for approval at the Building Development Management Department for the erection of a fence or boundary wall.
