Meeting with Councillor Diamond took place on the 13th of Feb 2018. During the meeting it was agreed that Mr Andre Human will submit a 1 page progress report indicating timeframes on the set development.

Councillor Andrea Crous (Ward Councillor: Ward 70) referred to the schedule on page 56 of the agenda that was submitted by Mr Andre Human. She said that there are many unanswered questions stemming from the report and requested a meeting with Mr Human in order to get clarity on the following as referred to on the Draft Galleria Contract Management Plan:
•1.1 Final Approval
e) High Court application dismissed.
•2.1 Purchase Price and Payment – To be monitored by CITY
b) Purchase price to be reviewed ito approved bulk and
•3.1 Lease Period
a) Lease agreement to be drafted and concluded
• Unauthorised changes to the tender documents.
PLEASE NOTE - on the 26th of March Mr Andre Human was invited to either attend the Activity day or the Subcouncil Meeting in order to discuss the questions Councillor Crous has.
A second reminder was e-mailed to Mr Human on the 9th of April 2018 and all Councillors were copied in on the email. Awaiting confirmation from Mr Human.

Page 46, Item 03SUB 23/08/2017 – MOTION WITH NOTICE FROM CLLR ANDREA CROUS – DISPOSAL OF THE BELLVILLE VELODROME AND BELLVILLE ATHLETIC STADIUM
At the previous Subcouncil meeting of 16 March 2018, Councillor Andrea Crous (Ward Councillor: Ward 70) said that there were many unanswered questions stemming from a report that was submitted by Mr Andre Human (A copy is attached to the minutes). Mr Human was requested to attend the meeting in April 2018 in order to provide clarity on the following questions.
Section 1.1 Final Approval
f) Subdivision diagram submitted – March: Councillor Crous wanted to know if this action was completed in March as per the indication on the schedule:
Mr Human confirmed that it was submitted in March and final approval is expected in May 2018.
e) High Court application dismissed in July: Councillor Crous enquired as to what High Court application is still in process.
Mr Human said that when Council took a decision for the rezoning and subdivision of the property there was a condition attached, indicating that the developer should pay R25 million to the City, which he took on review to court. The matter is still with the court and they are busy with negotiations to settle the matter.
Councillor Crous said that at a previous meeting it was said that the Mayor wrote off the R25 million which stopped the court case.
Mr Human said that Councillor Crous’ information is not correct and that the court case must still be filed. The papers signed by the Mayor are currently being submitted to court which is a lengthy process.
Section 1.2 Manage contractual conditions
Councillor Crous referred to number a) Conclude service agreement – and wanted an explanation as to what it means.
Andre Human said that this has nothing to do with the approval. This is standard process when there is a big development like this. There is a service level agreement that gets signed between the City’s service departments (Electricity, Water) and the developer in terms of what he is going to provide and what the City is going to provide.
Section 2.1 Purchase Price and Payment – To be monitored by CITY
Councillor Crous requested an explanation referring to number b) Purchase price to be reviewed into approved bulk –
Mr Human said because they followed the rezoning process and because they were not sure what the outcome would be they went out on tender. They looked at various proposals of developers. The size of the developments were different and developers were asked to give the City a price if they get approval for 80 000 or 100 000 m² on bulk.
With the current development they received approval for 111 000 m² bulk. There is a price difference between what he tendered for on a 100 000 m² and what was granted for 111 000 m². The price of the land will be escalated.
SECTION 3.1 Lease Period
Councillor Crous asked Mr Human to confirm that the
a) Lease agreement to be drafted and concluded will remain the same.
Mr Human confirmed that the lease agreement will remain the same. The lease agreement was drafted in terms of the tender document whereby the Velodrome and athletic track will be upgraded and leased from the city.
Mr Human furthermore confirmed that the lease agreement has been signed and concluded by both parties. He said it stipulates that the Velodrome and athletic track will be upgraded by the developer and leased for a period of 30 years.
Mr Human concluded by saying that they are waiting for the final approval of the subdivision plan.

The following is an extraction from the Subcouncil minutes of 20 September 2018:
Councillor Andrea Crous (Ward Councillor: Ward 70) expressed her dismay with the feedback received from Mr Human indicating that he could not attend the meeting.
Councillor Crous expressed the importance of the matter for the sporting bodies making use of the Bellville Velodrome which is deteriorating as no maintenance is taking place due to this matter not being finalised.
Flowing from the discussion and on the suggestion from Councillor Suzette Little, the Chairperson was requested to address a letter to the Mayoral Committee on the subject matter.

The following is an extraction from the minutes of 18 October 2018:
At this point, the Subcouncil Manager recused himself from the discussion of the Velodrome due to his personal interest in the matter.
Councillor Andrea Crous (Ward Councillor: Ward 70) again expressed her dismay regarding this serious matter. She said that she recently visited the Velodrome while an event was taking place and she felt ashamed of the dilapidated state that the building was in. It was visibly clear that the building is being neglected. Councillor Crous was of the opinion that it is because the developer is not forced to take over the building.
Councillor Crous referred to the previous Subcouncil meeting where she requested Mr Human to supply the Subcouncil with feedback within 7 days after the meeting of 20 September 2018, it being 28 September 2018.
Councillor Crous furthermore referred to the request of Councillor Little at the 20th of September 2018 Subcouncil meeting that a letter regarding the concerns around the Velodrome be submitted to the respective Mayco Member and that this matter be placed on the Agenda of the next Mayco meeting. However, according to Councillor Crous the letter was sent to Councillor Stuart Diamond (Mayco Member) on the 11th of October 2018.
A suggestion was made by the Chairperson to take the matter up with the City Manager. Councillor Crous then indicated that she will take the matter up with the Speaker.

Alderman James Vos reported that the matter is being dealt with by a legal team and Property Management. It was noted that a report will serve at the Council meeting in due course.

An e-mail was sent to Alderman James Vos on the 9th of April 2019 requesting whether the Bellville Velodrome report will serve on the agenda for the Council meeting in April 2019. Feedback is awaited.
Councillor Andrea Crous was included in the correspondence.

A) That Councillor Crous’ motion be supported and the Subcouncil Manager be tasked with:
1. Requesting the Director: Property Management for a full report regarding the process of disposal of Erf 21750, known as The Velodrome and Bellville Athletic Stadium. The report must include reasons why the process is being prolonged.
2. Compile a task team to meet every two months and report back to the Subcouncil in order to expedite the conclusion of the process.
3. Request DEVMET to do a presentation to the Subcouncil regarding the proposed development and management of The Velodrome and the Bellville Athletic Stadium.
4. That the Chairperson, Councillor Carstens facilitate a meeting with the Mayco Member: Assets & Facilities, Councillor Stuart Diamond.
5. That the motion remains on the Matters Receiving Attention schedule until concluded and that resolution 2 – 5 be suspended until the report from Property Management is received.
