UNANIMOUSLY RESOLVED that:
a. The application for deletion of a condition of rezoning approval for Erf 7669, Somerset West, limiting the use of the property to guest house only BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015

b. The application for regulation departure from the DMS for Erf 7669, Somerset West, to permit the floor factor of 1 to be increased to 1,04, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015

c. The application for regulation departure from the DMS for Erf 7669, Somerset West, to permit a height of 15,935m in lieu of 15m for a portion of proposed Block A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015

d. The application for Site Development Plan no 23AE/01/S001 – S007 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in attached Annexure A

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following changes:

Amend reason 6.6 as follows:
6.6 Contrary to the objections, current congestion levels, especially at the Main Road/Dummer Street interSection, are not considered significant and will not be significantly compounded by the additional traffic generated by the proposed development.

Add reason 6.13 as follows:
6.13 The development proposal satisfies the desirability criteria contained in Section 99 of the By-Law as well as the development principles contained in Section 59 of Land Use Planning Act (2014) and Section 7 of Spatial Planning and Land Use Management Act (2013)


Annexure A:
Amend condition 24 as follows:
24 That all services are to be inspected by the Water & Sanitation Department on completion of works and a completion certificate to be obtained prior to the utilization of the new buildings

Amend condition 28 as follows:
28 That the owner of the treatment plant is responsible for obtaining all legislative approvals for the packaged wastewater treatment plant prior to the utilization of the new building and commissioning of the facility and the owner remains solely responsible and liable for the performance of the packaged wastewater treatment plant as well as any other obligation that may be imposed by approvals/ licences issued to the owner by the relevant government department(s)
