UNANIMOUSLY RESOLVED that:
The application for permanent departure, as set out in Annexure A, for Erf 19224 at 38B Oosterlig Street, Strand BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no CD 100 drawn by R. Dirkse dated March 2023.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 7.1.4 as follows:

7.1.4 The casting of shadows will not have a negative impact on adjoining properties from morning to midday. The objecting property, Erf 2307-RE, is situated on the eastern side of the subject property; therefore, the proposed development will not have a significant negative impact on the sunlight available to erf 2307-RE.
