Resolution details

RESOLVED UNANIMOUSLY that:

a. The application for the subdivision of Erf 2941 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/16/2941, subject to the conditions contained in Annexure A.

b. The application for a departure, as set out in Annexure A, for Erf 2941 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

Additional Condition 2.2 that reads as follows:

2.2 Each portion is restricted to a single dwelling only.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the planner’s report except reason 7.1.10 which is amended as follows:

1. The proposed condition that will restrict each portion to a maximum permitted floor space of 750m2 and the erection of a single dwelling only on each portion will significantly mitigate the potential impact of the subdivision (ie the existing permitted floor space of 1500m2 will be divided equally between Portions 1 and 2).
