UNANIMOUSLY RESOLVED that:
a. The application for rezoning of a portion of Erf 23889-RE, Maitland from General Residential Zone 4 to General Residential Zone 5 in terms of Section 42(a) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-Law, 2015, in accordance with Drawing No. 1-9 Rev F dated 15/08/2019 attached as Annexure C, and subject to the conditions contained in Annexure A.
b. The application for a permanent departure to permit a street setback of 0m in lieu of 4.5m above 10m in height along Voortrekker Road in terms of Section 42(b) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:
7.1.9 Given the designation of the site within the PT2 boundary and the proximity of public transport, the requirements for a TIS study is regarded as being unnecessary
Amend Annexure A:
Add 3.5 Provision for bicycle and motorbike embayments shall be made available within the complex, to the satisfaction of the relevant official
Add 3.6 The treatment of the parking areas needs to be done in such a way that they serve a dual function as play areas
