RESOLVED that:
The application for departures as set out in Annexure A on the Remainder of Erf 401 Sea Point West, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and agreed to:
Replace reason 7.1.1 with the following:
The parking layout does not conform with the City’s Parking Policy
Add new reason:
The application does not contain adequate clarity on the nature of the land use or the intent of the land use
Amend old reason 7.1.5 as follows:
The building line and coverage departures which relate to the development proposal are also not supported.
Add new reason:
The application is not compliant with elements of the Urban Design Policy and the Tourist Accommodation Policy
Delete reason 7.1.4 and update numbering sequence accordingly.
