RESOLVED that:
a. The application for the approval of Council in respect of the subdivision in a Heritage Protection Overlay zone as contained in Annexure A attached in respect of Erf 546, 44 Forest Drive Pinelands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law subject to conditions contained in Annexure A attached.
b. The application for the subdivision of the property in accordance with subdivision plan as contained in Annexure B attached in respect of Erf 546, 44 Forest Drive Pinelands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with conditions contained in Annexure A.
c. The application for the Consent in terms of the title deed to permit more than one dwelling house on the property and to subdivide the property as contained in Annexure A attached in respect of Erf 546, 44 Forest Drive Pineland, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law subject to conditions contained in Annexure A attached.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend Annexure A:
Delete 1st bullet point in paragraph 3.1
Add new 4.1.3:
The SDP and building plan shall be fully compliant with the prescriptions and requirements of the HPOZ and Council’s Heritage Department
Add new heading with paragraph:
4.4 TITLE DEED:
The title deed clause restricting more than one dwelling be re-imposed on the newly created erven.
Update numbering sequence accordingly.
Parties were advised of their right of appeal
