UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 300.00 for the unauthorized building work, BE DETERMINED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 1146 Watt Street, Gordons Bay.




REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend point 2 as follows:

The extent of the contravention is significant due to the height and length of the retaining wall but the impact on adjoining public passage is minimal

Amend paragraph 5.4 in the planner’s report as follows:
In view of the aforementioned considerations in terms of Section 129(8), this department recommends that an amount of R 300.00 administrative penalty be applicable.
