UNANIMOUSLY RESOLVED that:
An administrative penalty of R 10 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 1676, Camps Bay.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to update the numbering sequence and amend reasons as follows:
5.1 The building work was started without prior approval from Council.
5.2 The contravention is relatively large and the gravity relatively serious
5.3 The duration of the contravention is long, approximately 4 years
5.4 The alterations are not contrary to the prevailing built form or appearance of the building.
5.5 As far as can be ascertained, the owner of the property has not previously contravened this By-Law or any other planning law
