UNANIMOUSLY RESOLVED that:
a. The application for departures from the Development Management Scheme, as set out in Annexure A, for Erf 112598, Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, in accordance with Annexure C.
b. The application for City approval in terms of the Development Management Scheme, as set out in Annexure A, for Erf 112598, Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, in accordance with Annexure C.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend 7.1.6 as follows:
The proposal will not have a material negative impact on existing rights.
Amend Annexure A:
1.1 Item 22(d): To permit additions beyond 12m from the street to be set back 1,45m from the northern, 0m from the southern and 1,1m from the western boundaries for a linear length of 15,022m in lieu of 11,31m.
1.2 Item 22(c): To permit the height of additions beyond 12m from the street on the south and north boundaries to be 5,6m in lieu of 4,0m.
1.3 Item 22(d): To permit a first-storey addition to be set back 1,45m in lieu of 3,0m from the north boundary.
1.4 Item 22(d): To permit a first-storey addition to be set back 0,0m in lieu of 3,0m from the south boundary.
1.5 Item 22(d): To permit a first-storey addition to be set back 1,1m in lieu of 3,0m from the north boundary.
1.6 Item 22(e): To permit window openings to be set back 1,45m in lieu of 1,5m from the north boundary.
