UNANIMOUSLY RESOLVED that:
a. The application for Council’s consent, as set out in Annexure A, for Erf 3151 Pinelands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the plans attached as Annexure C and subject to conditions in Annexure A.
b. The application for relaxation in terms of restrictive title deed conditions, as set out in Annexure A, for Erf 3151 Pinelands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the plans attached as Annexure C and subject to conditions in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and amend:
7.1.5 The application is considered desirable and will not have a material negative impact on neighbouring properties or existing rights provided that conditions are imposed to mitigate impacts are complied with
Delete reason 7.1.6
Amend Annexure A:
Delete duplicate words ‘to permit’ in sentence above paragraph 3
Amend 3.5 The remainder of the site shall be used for permanent residential purposes
Add new 3.7: The approval for the consent use for a place of instruction (swimming school) be limited to a period of three (3) years
