Resolution details

UNANIMOUSLY RESOLVED that:
a. The removal of the restrictive title deed conditions as set out in Annexure A in respect of erf 5012, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The amendment of the original town establishment conditions as set out in Annexure A in respect of erf 5012, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. The regulation departures as set out in Annexure A in respect of erf 5012, Milnerton BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend:

7.1.2 There will be no social benefit of the restrictive conditions remaining in place as elaborated on in the planning report

Delete reasons contained in paragraph 7.2

Update the numbering sequence (7.3.1 becomes 7.2.1 etc)

Amend Annexure A:
2.1 becomes 1.2 under:
Heading: Applications granted in terms of Section 98(b) of the By-Law

Update numbering sequence: old 1.2 becomes 1.3, old 1.3 becomes 1.4; old paragraph 3 becomes paragraph 2
