UNANIMOUSLY RESOLVED that:
a. The application for subdivision, as set out in Annexure A, for Erf 1039 Fresnaye, BE APPROVED in terms of Section 98(b) of the City of Cape Town Planning By-Law, 2015, subject to the conditions contained in Annexure A, in accordance with the subdivision plan in Annexure C2.

b. The application for departures, as set out in Annexure A, for Erf 1039 Fresnaye, BE APPROVED in terms of Section 98(b) of the City of Cape Town Planning By-Law, 2015, subject to the conditions contained in Annexure A, in accordance with the subdivision plan in Annexure C2 and Site Development Plan in Annexure C3.

c. The application for the deletion of restrictive title deed conditions, as set out in Annexure A, for Erf 1039 Fresnaye, BE APPROVED in terms of Section 98(b) of the City of Cape Town Planning By-Law, 2015.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.

Amend Annexure A:
1.3.2 That the registration of a height and right of way servitude over the proposed roof of Portion 1 in favour of the Remainder be implemented
