UNANIMOUSLY RESOLVED that:
a. The deletion of the restrictive title deed conditions as contained in Annexure A attached in respect of Erf 281, 6 Victoria Road, Clifton BE APPROVED, in terms of Section 98 of the Municipal Planning By-Law subject to conditions contained in Annexure A attached and in accordance with the plans in Annexure C.

b. The amendment of the restrictive title deed condition as contained in Annexure A attached in respect of Erf 281, 6 Victoria Road, Clifton BE APPROVED, in terms of Section 98 of the Municipal Planning By-Law subject to conditions contained in Annexure A attached and in accordance with the plans in Annexure C.

c. The rezoning of the property as contained in Annexure A attached in respect of Erf 281, 6 Victoria Road, Clifton BE APPROVED, in terms of Section 98 of the Municipal Planning By-Law subject to conditions contained in Annexure A attached and in accordance with the plans in Annexure C.

d. The application for the departures as contained in Annexure A attached in respect Erf 281, 6 Victoria Road, Clifton BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law subject to conditions contained in Annexure A attached and in accordance with the plans in Annexure C.

e. The application for the approval of Council in respect of the building as contained in Annexure A attached in respect Erf 281, 6 Victoria Road, Clifton BE APPROVED, in terms of Section 98 of the Municipal Planning By-Law subject to conditions contained in Annexure A attached and in accordance with the plans in Annexure C.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend the 3rd bullet:

The parking deck will see the number of permanently used parking bays provided being reduced.

Delete reason 4

Amend Annexure A
Replace the words ‘Section 98’ in the subject headings with ‘Section 98(b)’ throughout Annexure A

6.2 Notwithstanding 6.1 above, the pedestrian access to the site shall be redesigned (with respect to the height, width and positioning) in order to minimise the impact thereof on the scenic drive. The redesign thereof shall be to the approval of the Director: Development Management in consultation with the Urban Design department.



It was noted during discussion that one panel member does not support the deletion of title deed condition C(6)

Note: The deck parking is of a temporary nature and must be designated as such
