UNANIMOUSLY RESOLVED that:
a. The removal of the restrictive title deed conditions as set out in Annexure A in respect of erven 302 and 35639, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The amendment of the original town establishment conditions as set out in Annexure A in respect of erven 302 and 35639, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The rezoning of erven 302 and 35639 Milnerton, from Single Residential Zone 1: Conventional Housing (SR1) to General Residential Subzone GR4 BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A;
d. The consolidation of erf 302, Milnerton with erf 35639 Milnerton BE APPROVED in terms of Section 98(b)(iii) of the Cape Town Municipal Planning By-Law, 2015 in accordance with the plan attached as Annexure C, subject to the conditions contained in Annexure A;
e. The regulation departure as set out in Annexure A on erven 302 and 35639, Milnerton BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend:
7.1.2 The removal will not have a significantly negative impact on the surrounding properties as no new land use, not already prevalent in the area, is proposed;
Amend:
7.2.3 The proposal supports the Economic Growth Strategy; Social Development Strategy; Transit Orientated Development Strategic Framework; Urban Design Policy; Densification Policy and Blaauwberg Road Management Strategy, as set out in Section 6.2.3 in this report;
Amend Annexure A:
2.1. The consolidation shall be in accordance with the plan depicted in Annexure C.
2.21 The landscaping plan (Drw. no.: ENRICH-EN302-01, REV. 2); dated 28 February 2018; compiled by Enrich Horticultural and the revised Landscape Plan shall be implemented by, and at the cost of, the developer in accordance with the approved landscape plan, within the first winter rainfall cycle following the issuing of the occupancy certificate. However; if an alternative water source is available for irrigation purposes, the landscaping shall be implemented prior to the issuing of an occupancy certificate.
Add new:
A revised SDP shall be submitted which is generally in accordance with Annexure C, but must, in addition, resolve concerns relating to service facilities with respect to refuse, washing lines, storage, and that a revised landscape plan must be submitted which provides a minimum 2.5m wide landscape zone on the western edge of the consolidated property and that the zone is planted with trees to reduce the impact to neighbours on the western side, for approval by the authorized Official before building plan approval
At least 40% of boundary walls along the public street reserve shall be visually permeable, in compliance with Council’s Boundary Wall and Fences Policy
A Construction Phase Management Plan shall be submitted as part of the building plan submission
Delete conditions 2.22 up to and including 2.29
Parties were advised of their right of appeal.
