UNANIMOUSLY RESOLVED that:
a. The application for departures from the provisions mentioned in Annexure A attached to permit the restaurant and home for the aged in respect of Erf 3645, 21 Bowlers Way, Pinelands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law as set out in Annexure A.
b. The application for Council’s Consent to permit Flats on the property, in respect of Erf 3645, 21 Bowlers Way, Pinelands, BE APPROVED in terms of Section 98 of the Municipal Planning By-Law, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 1 as follows:
The application is in compliance with Section 99(2) of the Municipal Planning By-Law in that the proposal complies with the Special Zone A and various City policies, as motivated in Section 6.2 of the report
Add new:
The proposal satisfies the desirability criteria as set out in Section 99(3) of the Municipal Planning By-Law, as motivated in Section 6.2.4 of the report
Amend Annexure A:
3.1 An amended SDP shall be provided prior to the submission of a building plan showing amongst others, to the satisfaction of the competent authority (Director: Development Management):
The parking interface along Howard Drive and Bowlers Way shall be designed to be visually permeable and attractive, in accordance with the requirements of the Urban Design Policy. The Gardener Way site interface shall be retained as an active edge and shall be generally in accordance with that as presented on the SDP contained in Annexure C attached.

Refuse room shall be provided to the satisfaction of the delegated Official
Add new:
The applicant shall submit a Construction Phase Management Plan
